You pay a monthly subscription plus the usage you actually generate. We work hard to keep the service running every Sunday, but live AI translation depends on outside technology providers and the internet, so we cannot promise it never fails and we cannot be held responsible for a lost broadcast. AI translations can contain mistakes. Prices can change with notice - if you disagree, you simply cancel. You can cancel at any time, with no binding period. This summary is here to help; the sections below are the agreement.
NovaSense ApS, a company registered in Denmark (CVR no. 46668235), contact info@novasense.dk ("NovaSense", "we", "us"). These Terms of Service (the "Terms") are the agreement between NovaSense and the customer ("you") for the use of our real-time translation service and related features (the "Service"). By creating an account or using the Service you accept these Terms.
The Service transcribes speech, translates it and produces spoken or written translations in real time, delivered through web pages for operators and listeners. The Service is available to churches and other organizations, companies, and private persons, worldwide, subject to these Terms and applicable law.
AI output. Transcriptions, translations and synthetic voices are generated by artificial intelligence. They are provided as a communication aid and may contain errors, omissions or mistranslations. The Service is not a certified translation service and must not be relied upon where accuracy is critical - including legal, medical, financial or safety-related communication. You are responsible for how the output is used.
Third-party providers. The Service depends on external technology providers (for speech recognition, translation, speech synthesis, hosting and payment processing). We choose and combine these providers, and we may replace any of them at any time to keep the Service running well.
You must give accurate information when signing up and keep it up to date. You are responsible for keeping your password confidential and for all activity under your account. You must be at least 18 years old to create an account. If you subscribe on behalf of a church, organization or company, you confirm that you are authorized to bind it to these Terms.
The price consists of a monthly subscription fee plus usage-based fees (per minute of live translation and per character of generated speech) at the rates shown on our website and on your account's usage page. All current prices are always visible to you before and during use. If you sign up part-way through a month, your first monthly subscription fee is prorated to the days remaining in that month - you never pay for days before your signup.
Promotions. Prices may include a promotional discount (for example on the monthly subscription). Promotions can be changed or ended for future billing periods with notice as described in section 5.
Payment is handled by our payment provider (Stripe). Depending on your choice, your card is charged automatically each month for the previous month's subscription and usage, or you pay with a prepaid credit balance that is drawn down as you use the Service. Invoices are sent by email. If an automatic payment fails, the payment provider retries; if payment continues to fail we may suspend the Service until the balance is settled. Prepaid credits are valid for 3 years from purchase and are not redeemable for cash, except where mandatory law provides otherwise.
Prices are shown without VAT unless stated otherwise; VAT is added where required by law based on your country and customer type.
We may change prices, introduce new fees or end promotions with at least 30 days' notice by email, effective from a following billing period. If you do not accept a change, you may cancel before it takes effect; continued use after the effective date counts as acceptance.
Extraordinary provider changes. If a third-party provider we depend on materially raises its prices, restricts its service or discontinues it, we may - to the extent reasonably necessary - adjust the affected usage prices, substitute the provider, or modify or withdraw the affected feature at shorter notice. We will always inform you by email as early as we reasonably can, and you may cancel at any time in response.
The Service is provided "as is" and "as available". We aim for high availability and monitor the Service actively, but we do not guarantee uninterrupted or error-free operation. The Service depends on third-party AI providers, hosting infrastructure, payment providers and the public internet, as well as your own equipment, microphones and internet connection at the venue. Planned maintenance will be placed outside typical service hours where possible. Your sole remedy for extended unavailability caused by us is a proportional reduction of the monthly subscription fee for the affected period, upon request.
You may use the Service only for lawful purposes. You may not resell or white-label the Service without our written agreement, attempt to circumvent metering, capacity limits or security, reverse-engineer the Service, or use it in a way that degrades it for others. We may set and adjust reasonable technical limits (for example the number of simultaneous language channels).
The subscription runs month to month with no binding period. You can cancel at any time directly from your account page (Account tab) or by email, with effect from the end of the current billing period (the calendar month). You keep full access until then, and your final invoice covers only the subscription and usage up to that date; usage already generated remains payable. We may terminate with 30 days' notice, and with immediate effect in case of material breach, non-payment, or misuse of the Service. Upon termination we may delete your account data after a reasonable period, subject to legal retention duties.
If you subscribe as a private consumer in the EU/EEA, you have a 14-day right of withdrawal from the day of signup. At signup you ask us to start providing the Service immediately. If you withdraw within the 14 days, you pay only for the part of the Service already delivered (the proportional subscription and the usage generated), and we refund the rest. To withdraw, email info@novasense.dk with a clear statement that you withdraw from the agreement.
To the maximum extent permitted by applicable law:
(a) we are not liable for indirect or consequential losses, including lost profits, lost data, lost donations or collections, reputational harm, or the consequences of an interrupted or incorrect broadcast or translation;
(b) our total aggregate liability under this agreement in any 12-month period is capped at the total fees you paid us for the Service in the 12 months before the event giving rise to the claim;
(c) we are not liable for failures caused by third-party providers, networks, or your own equipment or connectivity.
Nothing in these Terms excludes or limits liability for gross negligence or intent, or any liability or consumer right that cannot be excluded or limited under mandatory law, including the mandatory consumer protection rules of the country where you live.
Neither party is responsible for failure to perform caused by circumstances beyond its reasonable control, including - without limitation - outages, shutdowns, sanctions-related restrictions or sudden material price increases at third-party AI or infrastructure providers, internet or power failures, cyber-attacks, war, natural disasters, epidemics, or acts of authorities. Payment obligations for usage already delivered are not suspended by force majeure.
Audio from your services is processed in real time to produce transcriptions and translations and is not kept longer than needed for that processing and for metering. Account and billing data are processed to operate the Service under the EU General Data Protection Regulation (GDPR). Some providers may process data outside the EU/EEA under appropriate safeguards (such as EU standard contractual clauses). Questions about data: info@novasense.dk.
We may update these Terms. For material changes we give at least 30 days' notice by email before they take effect. If you do not accept the new Terms you may cancel before the effective date; continued use after that date counts as acceptance. The version number and effective date at the top of this page always show the current Terms.
These Terms are governed by Danish law, excluding its conflict-of-law rules and the CISG. Disputes are settled by the Danish courts with the City Court of Copenhagen as agreed venue for business customers. If you are a consumer, you additionally keep the protection of the mandatory rules and competent courts of the country where you live, and you may use the EU online dispute resolution platform at ec.europa.eu/consumers/odr or complain to the Danish consumer complaints bodies via naevneneshus.dk.

If any provision of these Terms is held invalid, the remaining provisions stay in force. Our failure to enforce a provision is not a waiver of it. The English version of these Terms is the binding version; translations are provided for convenience only.
